Terms & Conditions

Rockbridge Global Village (RGV) has established the following Terms & Conditions, acceptable use policies, and general company policies for user accounts.

Use of any RGV service constitutes acceptance of these Terms and Conditions. All users are subject to conditions set forth under United States Law and Virginia State Law.

RGV exercises no control whatsoever over the content of the information passing through our connections and computers. We make no attempt to restrict access to the Internet and believe it is the individual’s, family’s, or business’s responsibility to control access. RGV makes no warranties of any kind, whether express or implied, for the service it provides. RGV also disclaims any warranty of merchantability or fitness for a particular purpose.

RGV is not responsible for damages to data or equipment due to installation or configuration of any software or hardware product. It is the user's responsibility to completely back up the system and important data prior to any configuration changes or installation of software or hardware.

RGV is not responsible for data received or sent through an internet connection. RGV will not be responsible for any damages you may suffer as a result of files sent or received via your Internet connection. This includes, but is not limited to, loss of data resulting from delays, non-deliveries, mis-deliveries, or service interruption caused by its own negligence or your errors or omissions.

Use of any information obtained via RGV is at your own risk. RGV specifically denies any responsibility for accuracy of information obtained through our service.

RGV services may only be used for lawful purposes. Transmission or reception of any material in violation of any US or state regulation is prohibited and is grounds for immediate account termination. This includes, but is not limited to, copyrighted material, trade secrets, material legally judged threatening or obscene, or the use of threatening or obscene language.

You agree to indemnify RGV and hold RGV harmless from any claims resulting from your use of the service that damages you or another party.

Pre-payments for accounts terminated for reasons set forth herein are not refunded.

Services MUST be paid for in advance. Checks returned to RGV unpaid are subject to a $25.00 returned check fee from RGV and immediately place the account in default. 

Payments not received within 10 days after the start of the monthly billing period place the account in default. Accounts in default are subject to interruption. Interruption of service does not relieve you of your obligation to pay the monthly fee. 

Only a written cancellation request 30 days in advance relieves you of your obligation to pay subsequent monthly fees. Failure to provide 30 days cancellation notice may result in a $30 disconnection fee.

Accounts in default are subject to interest charges of 1.5% per month on the outstanding balance. If you are in default you agree to pay RGV its reasonable expenses, including attorney and collection agency fees, incurred while enforcing its rights set forth in these Terms and Conditions.

RGV reserves the right to refuse to grant accounts, as well as terminate accounts when deemed reasonable by RGV.

RGV reserves the right to cancel service accounts, type of accounts and change pricing structures at will and without prior notification. 

These Terms and Conditions supersede all previous representations, understandings, or agreements and shall prevail notwithstanding any variance with terms and conditions of any other order previously submitted.

Acceptable Use Policies: Dial-Up Accounts

An account may not be accessed simultaneously by multiple users or by one user from multiple computers.

The customer is responsible for all local, long distance, and "800" telephone charges for connecting to the service.

RGV shall have no responsibility for any charges or tariffs related to any telephone customer connection or online services of any entity accessed by or for connecting to the customer or customer's location.

RGV shall, subject to the Terms and Conditions, and acceptable use policies, provide subscribers access to the Internet.

RGV makes no other warranties and specifically disclaims any implied warranties of merchantability, fitness for a particular purpose, or against infringement.

RGV further disclaims any warranty or representation as to the Internet, any information derived thereof and to the accuracy or privacy thereof.

RGV makes no warranty of services if subscriber experiences problems connecting to RGV and the Internet due to subscriber system/computer difficulty or errors.

RGV further disclaims that subscribers will be able to access the service 100% of the time during peak periods or down conditions.

Acceptable Use Policies: Personal Web Space

Personal web pages are provided by RGV for personal enjoyment. Selling products or services in this space is prohibited.

RGV recommends creating and keeping backups of all materials; RGV is not responsible for damage or loss of any data stored on our server.

There is a bandwidth limitation of 100MB of network traffic per month per personal web page. If a personal web page transfers in excess of this amount, it will be considered a commercial site and the account holder will be notified.

Acceptable Use Policies: Email Accounts

RGV exercises zero tolerance for spamming, which is prohibited by Virginia State Law.

Please address any spamming and abuse complaints to abuse@rockbridge.net with a complete copy of the entire message, including headers. We do not need a copy of each message if the messages are identical. Many Spammers will use evasive measures to hide their true identities so it is important that you include a copy of the original message, unedited, complete and fully intact.

RGV is not responsible for the content of messages or files passing through its system. While we provide the post office service, we do not monitor or filter any content. There are programs available for security issues and virus detection and cleansing.

Specific Contract Terms for DSL Service

First monthly payment is due at the time contract is executed, which is the first day service is active on the selected service line.  RGV’s on-site consulting and networking fees are per hour, which if used are billed separately from the contract.

Contract duration must be met in full and customer must abide by the guidelines set forth in the terms and conditions of this contract.  A fee for early termination of contract will be calculated at six full months of service selected, payable upon the termination of contract. 

All rented equipment must be returned on that date, in good and working condition along with original packaging, or the retail cost of that equipment will be payable at that time as well.

Actual performance may vary due to conditions outside of RGV's network control.  These conditions may include variables such as customer location, physical equipment limitations, network congestion and server and router speeds of web sites accessed, inside wiring, or telephone line conditions.

Unless either RGV or the Customer terminates Service in writing, the contract will extend under the original terms, conditions, and rates on a month-to-month basis at the conclusion of the term indicated on the original contract.

RGV reserves the right to modify the acceptable use policy and the terms and conditions of service at any time and without prior notice.
